The fanatics won’t need a license transfer to launch in New York

Recently, Fanatics announced a major contract to acquire PointsBet U.S. to gain access to sports books that lead the U.S. online gambling market. This includes New York, the main jurisdiction of U.S. online sports betting. It has been announced that there will be no need to transfer licenses to start legitimate operations in Empire State’s digital sector.

Earlier this month, Panatix Betting & Gaming announced that it had signed an agreement to purchase PointBet’s U.S. assets for US$150 million. Once confirmed, Panatics will be able to join leading domestic markets such as the New York market. Opened in January 2022, the first year generated US$700 million in tax revenue from state finances.

Rob Williams, executive director of the New York State Gaming Commission, said the company would not need to transfer licenses to continue its business in Empire State. He also said last week’s meeting required staff review of the deal, and that staff will now begin background checks on fanatics and related assets.

Mr Williams reminded me that regulatory staff are already contacting Fanatics to provide licensing documents. Employees also shared that they were disseminating open requirements before reviewing licenses. Now, the process will probably require a full review of the company’s technology platform being leveraged to provide mobile sports betting in the state.

For in-state operations, the company has described several marketing benefits that help it succeed. Starting with well-known brands with extensive digital and retail assets and large budget and acquisition models, multi-platform retention programs and strategic marketing partnerships can help you stand out in the competition.

Finally, Mr Williams recommended considering relocation at the Commissioner’s level, rather than at the staff level, supported by the regulator’s Chairman Brian O’Dwyer. However, the Commission did not provide a period of approval. The Phase 1 deal should be completed around August 31, 2023, when the company likely secured a principal owning and operating PointBet’s activities in at least three states.

But it should be noted that fanatics will have difficulty entering markets dominated by FanDual and DraftKings. In March 2023, the two operators generated $740 million and $590 million in bets, respectively. This was a major part of Empire State’s handling of $1,785,952,977 this month.
